If you think being on a slab is getting away, then fine, I prefer to see it as the criminal getting busted in an unconventional way, a tool if you will similar to shooting him.

The bad guy is not robbing anyone else, he is not sitting at home laughing about "almost" getting busted, so clearly that is a win for society.

Who cares if the cops did not get an official arrest, the results are all that matter to me.
