    1. Certainly Prop 8 had to be deemed favorable to a specific group for the court to rule it unconstitutional. Certainly that group wouldn't be gays so all that is left are heterosexuals.

I am not familar with California Law so I don't know if there is any legislation exclusively protecting gays. But if there is this Prop 8 ruling can be used to strike down laws establishing civil unions and other statutes favoring the gay community above heterosexuals.

Let me explain it in terms even you may understand:

Let's say you have 20 apples. How many apples out of 100 do you have? If you say, "I have 20 apples out of 100, teacher" you would be correct. You get a gold star. You could also say, "I have 1 in 5 apples, brilliant teacher" and you would also be correct.

Now, let's say you have 22 apples. How many apples out of 100 do you have? If you say, "I have 22 apples out of 100, smart teacher" you would be correct again. Another gold star.

Stay with me, it's almost recess time...

Now, little Moen, if I tell you that 22 wacky liberals voted for Prop 8 you might say to yourself, "Ohhhhh, I don't like those bad, bad liberals". That's OK, little Moen neither do I. But, on with our lesson. Now you have 22 apples out of 100 that can also be represented as 1.1 in 5. "But adept instructor", you say, "I'm confused! How can we have a '.1 liberal' without cutting him up into small pieces"? Don't worry little Moen, we will just round the number to the nearest factor of ten for the sake of argument and so that we don't have to cut up a liberal.

"Oh, I see now" say you, "without adding the extra 2%, it appears that less liberals voted for that nasty, old Prop 8"! Yes little Moen, we can round to the nearest factor of ten like that and not have to deal with those pesky decimals and the liberal can go about his ignorant, blissful life totally intact.

    Get it?

That's not why it was ruled unconstitutional. I invite you to read the decision in Perry v. Schwarzenegger to learn the actual reasoning which was upheld by the appeals court in its recent decision. In short: Prop 8 discriminates against homosexuals while advancing no legitimate governmental interest. It does nothing at all to "protect heterosexuals," and was not favorable to heterosexuals. Your argument on this point has no basis in fact.

Why would allowing gays to get married be "favoring the gay community above heterosexuals"?
