I believe he should have the right to have the evidence tested by an independant laboratory.

 

I say if there is something that can be considered DNA evidence, then the prosecution MUST have it examined.

Innocent till proven guilty should apply to the prosecution as well. If they have info that might absolve the defendant, then they should pursue freeing the guy even if it costs them a case.

I agree. At any point DNA can prove or disprove innocence it needs to be used ASAP.
