BO's Healthcare Unconstitutional?

    The Attorney General of Florida was on FOX this morning and claimed Obamacare, in it's current form, is unconstitutional based on the fact that the powers enumerated in our Constitutuion do not allow the federal government to mandate the citizens take part in a govn't healthcare program and certainly do not allow people to be fined or jailed for not having insurance.

    Did he say were in your Constitution it says this? Have to agree it is stupid to put people into jail or fine them for not having insurance

    Our Constitution DOES NOT give the federal government the right to impose this on us therefore it is unconstitutional. The powers of the federal government are plainly laid out in the Constitution, unless the libs can get an amendemet passed it can't legally happen.

    The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

    This provision makes it clear that the federal government is limited to certain specific powers. The federal government can do only what the Constitution says it can do.

    Most of what the federal government does is unconstitutional in that sense.

    Your right, but that is what the constitution states. 50+ years of a mostly democrat congress has caused this mess we are in now. Also the pathetic court system and string of liberal judges that want to try a legislate the law instaed of interperting it.

    IF it's ruled constitutional (and that's an IF in capital letters), it will be under the interstate commerce clause. For the better part of a century, the Supreme Court has given Congress CONSIDERABLE leeway to define "interstate commerce." I would be interested to see how this Court rules. It generally limits itself to the specifics of individual cases, so I guess it depends on how the case challenging any healthcare mandate is drawn up and argued.
