MADISON, Wis. A Wisconsin judge has struck down Republican Gov. Scott Walker's legislation repealing most collective bargaining for public employees. In a 33-page decision issued Thursday, Dane County Circuit Judge Maryann Sumi said she would freeze the legislation because GOP lawmakers on a committee broke the state's open meetings law in passing it March 9. The legislation limits collective bargaining to wages for all public employees in Wisconsin except for police and firefighters. "It's what we were looking for," said Dane County District Attorney Ismael Ozanne, a Democrat. Ozanne sued to block the law after Assembly Minority Leader Peter Barca, D-Kenosha, filed a complaint saying that GOP legislative leaders had not given proper notice to the public in convening a conference committee of lawmakers from both houses to approve Walker's budget-repair bill. Question: When is it called "legislating from the bench"? Answer: When the judge guilty of it disagrees with your views. If I remember right, Sumi ruled against the law because proper notice wasn't given before the vote. But, I'm sure the state's Supreme Court overturned that verdict because they wouldn't even THINK of legislating from the bench themselves... ... my (_l_)
Actually, in WI, they just want the public sector unions to pay for a small portion of their tax payer funded benifit plan. Thats pretty reasonable, if I were in charge, I would have just rounded up those fookin union strikers and gassed the whole gang of them. Unions are pondscum, even lower than Republicans. The union already agreed to pay a higher portion of both their retirement and their medical benefits but that wasn't what the power grab was about. It was about taking worker's rights away, specifically the right to collective bargaining. I also think that your Nazi death camp reference is appalling whether you intended it or not. The Wisconsin Supreme Court called it, "[usurping] the legislative power which the Wisconsin Constitution grants exclusively to the legislature." By that ruling, the WI Supreme Court ruled that Sumi's decision was not based on Wisconsin law. Therefore, if you accept when a judge "legislates from the bench", you're also accepting the fact that the law was circumvented. That's something I'll disagree with that all day long....
You are aware that the 4 Republicans on the Wisconsin Supreme Court decided that it was OK for the other Republicans in the State legislature to not follow the State Constitution regarding proper notice being given before a bill is voted on right? If anyone violated the State's Constitution, it was the Republicans at both levels of government. But that's OK because....?

As I see it, Sumi is more liberal and the Supreme Court is probably more conservative... it's just more politics lol ...and don't forget... laws can be political tools too...

Yeah, but I still say laws can be used politically too, and law-makers are easily corrupted... too easily, so when someone calls it "legislating from the bench" I have to ask if they understand the reasons why judges appear to do that. Laws are not absolute, they are temporary measures, and subject to changes periodically.
But you are ignoring the only provable fact that the Republicans did not wait the constitutionally mandated 48 hours before voting on the bill. Why is ignoring the constitution OK with you and apparently the rest of the Republicans in WI?

You see, the court's ruling had absolutely nothing to do with the constitutionality of the law. It only had to do with the unconstitutionality of a left wing judge's (Sumi) ruling.
